How company ownership becomes a residence ground
Serbian law does not list "I own a company" as a reason to live here. What it lists is employment, and self-employment is one form of it. The Law on Employment of Foreigners defines self-employment as work in a business you are the sole or controlling member of. So the first step is to register a company in Serbia, or register as a sole proprietor, and the entry on the business register is what your application rests on.
Since 1 February 2024 the residence permit and the work permit are one procedure and one document. It is called the single permit, jedinstvena dozvola in Serbian, and it is issued as a biometric card that records your right to work. Two authorities look at the file: the Ministry of Interior decides on residence, and the National Employment Service assesses the work side. The employment service has 10 days from a complete application to send its assessment, and the ministry has 15 days from a complete application to decide.
One detail surprises founders. Until the permit is issued, an owner or director who is not employed in the company may still act for it during a lawful short stay of up to 90 days. You can sign contracts and open the bank account. What you cannot do is stay past 90 days.
Founder vs managing director: which permit type you get
The role you register decides the route, and the routes are not equal. A founder who owns the company applies for the single permit on the basis of self-employment. A director who is not an owner is an employee of the company and applies on the basis of employment. Both end with the same card, but the second route carries an extra test.

The labour market test is a check by the National Employment Service for registered unemployed Serbian citizens who could fill the position. If a suitable candidate exists, the permit for that position is refused. It applies to employment, so a director without a controlling stake goes through it. A founder does not, which is the main reason most foreign founders make sure they hold the controlling stake before anything is filed.
For the self-employment route the employment service checks something else: that you have the qualifications for the activity the company is registered for. The rules on work permits ask for a certificate or document proving this. Pick an activity code you can back with a diploma, a licence or a work history, because a mismatch here is a refusal.
Company registration in Serbia comes first
Nothing can be filed for residence until the company exists. Most foreign founders use the limited liability company, written d.o.o. in Serbian, because the residence file is cleaner with financial statements and a company bank account behind it. Registration is electronic. The founding act has to carry an electronic signature, so either you come to Serbia to collect a qualified certificate, or you sign a power of attorney abroad, have it legalised and translated, and a lawyer here signs for you. Legalisation means the official stamp, usually an apostille, that makes a foreign document valid in Serbia. After registration the company needs a bank account, the share capital paid in, the electronic signature set up, and the beneficial owner recorded. Residence permit requirements for a company owner
The Law on Foreigners sets the core of the file, and the self-employment ground adds its own proof. Every document issued outside Serbia needs a court translation, and statements need a notary.
- Passport valid at least three months longer than the residence period you ask for
- Business register extract showing you as sole or controlling owner, director, or registered sole proprietor
- Proof of qualifications for the registered activity: diploma, licence or documented work history
- Lease or a signed landlord statement for your address in Serbia
- Proof of means of support for the period requested
- Health insurance valid in Serbia
- Employment contract or management agreement, for a director without a controlling stake
- Court translations of every foreign document, and proof of the fees paid
Proof of means usually means a bank statement showing at least the Serbian minimum salary for the year, or a contract or guarantee that does the same job. Health insurance means a policy valid in Serbia or proof of funds that would cover treatment. The passport rule catches people every year: it must be valid at least three months longer than the period you ask for, and a passport that is too short is a listed reason for refusal. Renew the passport first and you can ask for the full three years.
Who can file, and from where, depends on your nationality. If your passport lets you enter Serbia without a visa, the application can go in electronically during your lawful stay, and it can go in from abroad. If your nationality needs a visa, you first need a long stay visa D on the employment ground, and the permit application is filed during the visa's validity on that same ground.
How long the Serbia residence permit takes
Three clocks run in sequence. Company registration takes about five working days once the founding act is signed. Collecting the residence file is the longest part and it depends on you: translations, the apostille on foreign documents, the lease, the insurance policy. Then the statutory deadline is 15 days from a complete application, with the employment service's 10 day assessment inside it.
Complete is the word that decides the calendar. If a document is missing, the authority asks for it and the deadline waits. You attend once in person to give fingerprints and a photograph, and you receive a certificate of the started procedure with your foreigner registration number. A bank or an accountant can work from that number while the card is produced. With documents ready on day one, six to eight weeks from signing the founding act to holding the card is a realistic plan.
What the company formation route costs
The government side is small. The application fee is 430 dinars, and approval of the single permit costs 22,770 dinars, about 195 euros, under the Law on Republic Administrative Taxes. The amounts are adjusted every year, so we confirm them before anything is paid. Minimum share capital for a limited liability company is 100 dinars, so there is no investment threshold to meet.
The real cost is running the company. A limited liability company keeps double entry books and files annual financial statements, so a monthly accountant is a fixed cost from month one. A founder who works in the company without an employment contract still owes pension and health contributions on at least the minimum monthly base, and a director on a salary pays payroll tax and contributions on that salary. Then there is the registered address, and translations at every renewal.
Renewal, and what can cost you the permit
The single permit is issued for up to three years and renewed for the same period, as long as the reason it was issued still exists. That last clause is where founders lose permits. The authority renews on substance: a company that trades, pays its contributions, files its returns and is run from Serbia. A company that has done nothing for a year is a company that no longer supports the ground.
Four rules to keep in view:
- Start the activity within 90 days of receiving the permit. The Law on Employment of Foreigners makes this a condition of the self-employment permit.
- File the renewal no earlier than three months before expiry and no later than the day of expiry. A timely renewal lets you stay and work until the decision, and the new period runs on from the old one with no gap.
- Do not change your role without checking first. Moving from owner to salaried director, or selling down below a controlling stake, changes the basis of the permit and needs the employment service's consent.
- Closing the company ends the ground. If you plan to wind it down, tell us before you file anything, so the residence status is moved to another ground first.
Miss the renewal window and there is nothing to extend. You start again, and the three years you were building toward permanent residence start again with it.
From temporary residence to permanent residence
Every year on the single permit counts toward permanent residence in Serbia, which does not expire and does not have to be renewed. The condition is three years of continuous temporary residence, and continuous allows absences of up to 10 months in total or six months at once across the three years. The permanent residence application goes in no earlier than 60 days before the current permit expires and no later than its expiry.
Citizenship comes later, on the same ladder. Your spouse and children do not need a company of their own: once your permit is issued, they apply on family reunification with you as the anchor.

Frequently asked questions
Do I have to be in Serbia to apply for the permit?
Not to file, if your nationality does not need a visa: the application is electronic and can go in from abroad. You do have to attend once for biometrics, and you collect the card in person. If your nationality needs a visa, you enter on a long stay visa D and file during its validity.
Do I need to pay myself a salary to get residence as a founder?
No. A sole or controlling owner applies on self-employment and does not need an employment contract with the company. Contributions are still owed on at least the minimum base, so the company has a monthly cost even with no salary paid. A director without a controlling stake is a different case and does need a contract or a management agreement.
Can I hold the permit through a sole proprietorship instead of a company?
Yes. A registered sole proprietor is self-employed under the same law and follows the same procedure. The difference is liability and tax, not the permit: you answer for the business with your own property, and the flat rate regime only lasts while income stays under 6,000,000 dinars a year.
What if my passport expires before the three years are up?
The permit is issued only up to three months before the passport expires, so a passport with one year left gets you at most nine months of residence. Renew the passport before you apply, and if you renew it while the permit is running, tell the authority, because the card is tied to the document you applied with.
What happens to my residence if the company stops trading?
The permit exists because of the self-employment, so a company with no activity, no contributions and no filings does not support a renewal. If the business is not going to work, the answer is to move to another ground before the card expires, not to let it lapse and hope.
